Effective as of October 5, 2026
We know it's tempting to skip these Terms of Service, but it's important to establish what you can expect from us when using the Avalia360 platform and what we expect from you. As a platform aimed exclusively at the corporate and educational environment (B2B), these terms help define Avalia360's relationship with you and with the organization that enabled your access, in proportion to your interaction with our services.
These terms are also our privacy policy: the sections on student data, data subject rights and inactive accounts explain how we handle personal information, in compliance with the Brazilian General Data Protection Law (LGPD).
Avalia360's services are provided by the legal entity AVALIATECH TECNOLOGIA E EDUCACAO, registered under CNPJ No. 67.230.192/0001-01, headquartered in the judicial district of São Paulo/SP, Brazil.
Avalia360 is intended for people aged 18 or older. By creating an account or using the platform, you declare that you are 18 or older. It is not allowed to register, import or invite people under 18, and we may close the accounts of anyone who breaks this rule.
Accepting these terms is a condition for using the platform, and acceptance is tacit: by ticking the acceptance box, by creating the account or by continuing to use Avalia360 after the terms are updated, you accept them. We record the date and IP address of the acceptance. Anyone who does not accept the terms cannot use the platform and may decline and leave at any time.
The permission we grant you to access our ecosystem will remain active as long as you follow these basic rules of conduct:
To protect our systems and ensure the integrity of evaluations, you agree not to:
License: You retain the intellectual property and all rights to the original responses, data, and feedback you enter into the platform. For the system to function, you grant Avalia360 a global, non-exclusive, royalty-free license strictly to host, reproduce, process, and format your content for the sole purpose of generating the performance reports requested by your contracting organization.
The license above does not prevent the use of anonymized data described in the section on improving our models.
To keep improving our models, reports and analyses, we may use the answers and justification texts recorded on the platform after anonymizing them, that is, after removing names, emails, registration numbers and other identifiers, so that no person can be identified by reasonable technical means.
Anonymized data stops being personal data (LGPD, art. 12) and is not used to identify or evaluate anyone. Data that still identifies a person is not used for this purpose. For that reason, once anonymized, the data cannot be located or deleted at a data subject's request.
Your right to use the platform is directly linked to the commercial contract signed between AVALIATECH and the business or educational organization that provided your account. Your organization's administrator has the authority to assign, manage, access, or deactivate your user profile at any time.
If you use the free plan, the section above does not apply to you: the sections on the free plan and on student data apply instead.
The free plan is offered to teachers who use Avalia360 on their own, without a contract with their institution. It includes a personal workspace with up to 1 course at a time, 4 teams and 20 students, and the reports available on the free plan. A paid institutional plan can raise these limits.
We may change the limits and features of the free plan, giving 30 days' notice by email to the account address, and without deleting data already entered because of the change.
The free workspace is personal: it is not shared with colleagues or with the institution's coordination, and the teacher's institution has no access to it. If the institution contracts Avalia360, the teacher may keep the free workspace or move to the institutional plan, as agreed with the institution.
When importing or inviting students, the teacher provides name, email, team and, optionally, registration number.
The data is stored on servers located in Brazil.
Students may request access to, correction, anonymization or deletion of their data from the teacher or directly at [email protected], which is also the data protection officer's channel. We reply within 15 days.
When the request is for deletion, we delete the student's registration data in the workspace, and the evaluations they gave and received are anonymized: they no longer identify the student, preserving their peers' results.
If the free workspace goes 11 months without use, we send the teacher an email notice. If 12 months pass without use, we delete the workspace data (courses, teams, evaluations, answers, grades and reports) and the teacher's account. Use means signing in to the account.
Student accounts that exist only because of that workspace and have no other link are also deleted; accounts with other links remain, without the data of the deleted workspace. Teachers may delete the workspace earlier, at any time, by writing to [email protected].
We keep database backups and audit records, for security and LGPD compliance purposes, for up to 1 year. After that period, deleted data also ceases to exist in those copies.
These terms are governed by the laws of the Federative Republic of Brazil. Any legal dispute arising from the use of the platform will be resolved exclusively in the courts of the judicial district of Recife/PE.
